Mariana offered a Brazilian perspective, drawing on the findings presented in the paper “Merger Review in Brazil: A Status Report,” prepared for the conference.
Merger control in Brazil has evolved significantly since the enactment of Law No. 12,529/2011, aligning with international best practices to enhance both efficiency and predictability. While CADE has taken non-price factors—such as quality, innovation, and data protection—into account in certain cases, it has yet to provide detailed assessments or clear guidance on how these parameters are weighed in merger review.
